玖、相關規定

9. Relevant provisions

一、本基準中所提之金額，均以新台幣計算。

1. All amounts mentioned in this benchmark are in New Taiwan dollars.

二、依「公職人員利益衝突迴避法」之規定，申請者應主動據實表明身分關係。

2. In accordance with the provisions of the Law on the Avoidance of Conflicts of Interest by Public Officials, applicants should take the initiative to disclose their identity based on the facts.

三、凡向本基金會提案申請補助者，必須以繁體中文填妥本基金會規定之申請表格及必備相關資料，並依照本基準各項規定辦理；申請者必須在申請表適當項目填上資料，任何漏報資料，將負面影響審核結果，資料填寫經查明與事實不符者，本基金會得撤銷其資格。

3. Those who apply for subsidies to the Foundation must fill in the application form and necessary relevant materials prescribed by the Foundation in Chinese traditional Chinese, and handle it in accordance with the provisions of this Standard; Applicants must fill in the appropriate information in the application form, and any omission of information will negatively affect the results of the review, and if the information is found to be inconsistent with the facts, the Foundation may revoke its qualification.

四、本會於審查或補助執行期間，因業務需要，得將申請者檢具之計畫（或其一部分），交付該案所申請／獲補助之其他有關單位（包含但不限於文化部或其所（附）屬單位）供相互檢閱之用。唯僅限於該目的之使用。

4. During the period of examination or subsidy implementation, the Association may, due to business needs, hand over the applicant's plan (or part thereof) to other relevant units (including but not limited to the Ministry of Culture or its subordinate units) for mutual review. Use only for that purpose.

五、獲政府、政黨、學校、企業等「獨家贊助」之活動計畫，本基金會不予補助。六、申請者／獲補助者應確保其著作及申請計畫無侵害第三方合法權益之情事，如有任何侵權爭議應自行處理並承擔法律責任，並對本基金會負償還處理費用及

七、為營造有利於文化藝術工作之展演環境，獲補助者執行計畫，應依「勞動基準

Law, Gender Equality Work Law, Gender Equality Education Law, Sexual Harassment Prevention and Control Law, Sexual Assault Crime Prevention and Control Law, Ministry of Culture's "Guidelines for Cultural and Art Undertakings to Comply with Labor Laws and Regulations" and other relevant provisions to protect the relevant rights and interests of workers and other relevant persons. If there is any dispute, the subsidized person shall actively handle it in accordance with the law and bear legal responsibility. 八、獲補助者應公開發表計畫之成果（公開發表的形式包括權利人以發行、播送、上映、口述、演出、展示或其他方法向公眾公開提示著作內容）。

The recipient of the subsidy shall publicly announce the results of the plan (the form of public publication shall include the content of the work to be disclosed to the public by the right holder by means of distribution, broadcasting, screening, dictation, performance, display or other means).

九、獲補助者就所提供本基金會之相關文件、成果報告等著作及文件資料，同意無償授權本基金會為符合補助目的之公開發表及各項非營利性利用，並同意本基金會之利用及補助目的範圍內之再授權利用，不構成任何著作權之侵害。

9. The grantee agrees to authorize the Foundation to publish and use the relevant documents, achievement reports and other works and documents provided by the Foundation free of charge, and agrees that the use and sub-licensing of the Foundation within the scope of the purpose of the subsidy shall not constitute any copyright infringement.

十、為配合數位化作業系統，相關成果報告內容請以數位方式提供，詳見本基準各項目作業說明規定。

10. In order to cooperate with the digital operating system, the content of the relevant achievement report should be provided digitally, as detailed in the operation description of each project in this benchmark.

十一、獲補助者應於媒體宣傳稿、文宣品及出版品中，依指定方式將本基金會列為贊助單位。

11. The grantee shall list the Foundation as a sponsor in the designated manner in the media brochures, publicity materials and publications.

十二、所有申請資料及附件本基金會恕不退件。

12. All application materials and attachments will not be returned.
